General Terms and Conditions (GTC) of RAD Solutions
Applicability of the Terms
The following General Terms and Conditions (GTC) govern the deliveries, services and offers of the online shop of RAD SOLUTIONS Schweiz GmbH (hereinafter referred to as the "Seller") to the buyers. These GTC also apply to future business relationships within the scope of the online shop, even if they are not expressly agreed again. By placing an order, the buyer accepts these GTC. Deviations from these GTC require written confirmation by the Seller in order to be effective.
Offer and Conclusion of Contract
The offers of the Seller are non-binding and subject to change without notice. Acceptances and orders only become legally binding upon written confirmation by the Seller, which may also be given by dispatching the goods with a delivery note. All sales are made at fixed prices and always relate to specific quantities and items.
Prices
The prices are stated in Swiss francs (CHF), from the Seller's stock, including normal packaging and the statutory value-added tax in force at the time. For orders up to a value of 200.00 CHF, shipping costs of 10.00 CHF are charged (shipping via Swiss Post). Orders over 200.00 CHF are free of shipping costs.
Delivery and Performance Time
Delivery dates and deadlines are only binding if they have been agreed in writing. All products offered in the online shop are available from stock and are shipped after receipt of payment. Delays due to force majeure or other unforeseeable events that make delivery difficult or impossible, such as strikes, official orders or blockades, release the Seller from compliance with bindingly agreed deadlines and dates. In such cases, the Seller is entitled to postpone delivery by the duration of the obstruction plus a reasonable start-up period or to withdraw from the contract.
Warranty and Notices of Defects
The Seller warrants that the delivered products are free from manufacturing and material defects. The statutory warranty periods apply, starting from the delivery date. Defects, incompleteness or incorrect deliveries must be reported in writing within 14 calendar days after delivery. If no notice of defect is given in due time, the delivery is deemed accepted. In the case of defects, the Seller provides remedy by free repair or replacement with an equivalent product. If this is not possible, the purchase price is refunded. Guarantee periods are not extended by guarantee services. Warranty claims lapse in the event of improper storage, use or unauthorized maintenance/repair by the buyer or third parties.
Right of Return
Returns of properly delivered products are only possible by prior arrangement and within 14 days of delivery, in original packaging and in new condition. Items that are ordered outside of the listed items and image intensifiers are excluded from the right of return.
Retention of Title
Until all claims of the Seller have been settled in full, the delivered goods remain the property of the Seller. The buyer must inform the Seller immediately of any access by third parties to the goods subject to retention of title.
Payment
Orders in the online shop are processed only against prepayment. The available payment methods are:
- Credit card (Visa, Mastercard, American Express)
- Apple Pay, Google Pay
Limitation of Liability
All claims of the buyer are governed by these GTC. Further claims are excluded, insofar as legally permissible. This also includes compensation for damage that did not arise directly from the performance itself, such as lost profits, damage caused by delay and other indirect and direct damage and consequential damage.
Severability Clause
Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. In place of the invalid or unenforceable provision, a valid and enforceable provision shall apply which comes closest to the economic purpose of the invalid or unenforceable provision. This applies accordingly to any gaps in the GTC.
Place of Jurisdiction and Applicable Law
Exclusively substantive Swiss law applies, excluding the CISG. The exclusive place of jurisdiction for all disputes arising out of or in connection with the contract concluded between RAD SOLUTIONS Schweiz GmbH and the customer is Hildisrieden, Switzerland.
